COLUMBIA, SOUTH CAROLINA — The man alleged to have fatally shot a former Niles resident has been taken into custody, according to Jessica McBrier, director of media relations for the St. Joseph County Prosecutor’s Office.
United States Marshals Service arrested Timothy Mayberry around 6 p.m. Wednesday on the murder warrant out of St. Joseph County. Mayberry was found in Columbia, South Carolina and was arrested without incident.
Mayberry’s charges stem from an incident that occurred around 2:17 a.m. Sept. 21 at Bleacher’s “The Bar” in Mishawaka, Indiana. Mayberry is alleged to have entered the bar and fatally shot Avery Christopher Brown, 28.
Brown was pronounced dead on scene. The St. Joseph County Metro Homicide Unit was activated to investigate the case.
McBrier said that they have not yet received information on whether Mayberry intends to waive extradition to St. Joseph County to answer the criminal charges here. If he declines to waive extradition, the St. Joseph County Prosecutor’s Office will commence extradition paperwork to have him brought back.
