Kevin Ryan Wall, 28, was given 180 days in jail during his sentencing hearing Friday morning in Cass County circuit court in Cassopolis, for charges of fleeing police, resisting arrest and possession of marijuana. Wall pleaded guilty to the charges on June 25.

According to Judge Michael Dodge, Wall was arrested on June 15, after fleeing from officers with the Berrien County Sheriff’s Office and Michigan State Police, who were attempting to apprehend the Dowagiac man in connection with a retail fraud.

When the police officers attempted to pull his vehicle over near Oak Manor school in Niles, Wall sped off, leading the police on chase that ended in the streets of Dowagiac.

“Ultimately, you were running away on foot when you were tazed by officers and eventually placed under arrest,” Dodge said.

Due to the fact the incident was incited in Berrien County, Wall also faces similar charges from authorities in that county as well, Dodge said.

While police were not seriously injured during the chase, Cass County Prosecutor Victor Fitz said that jail time was an appropriate punishment for Wall’s behavior that day due to the fact that it exposed the officers to unnecessary danger. The prosecutor pointed out that the investigative report stated that Wall nearly hit one of the officers with his truck at one point, and later threw a piece of wood at one of them while running away on foot.

“Blue lives do matter,” Fitz said. “These guys [police] don’t deserve this, and this defendant needs to be held accountable for endangering not only the police officers but other people who could have been involved as well.”

Wall has been dealing with problems with mental health along with abuse of methamphetamine, though he has been treating the latter problem through his participation in a meth recovery program in Van Buren County, said Wall’s attorney, James Miller.

“Hopefully you have benefited from some of the things you have learned in those classes, because you’ll really need some help to avoid using that substance in the future,” Dodge said.

Wall was given 61 days credit for time already served. His jail time can be served in any correctional facility, due to the pending charges against him in Berrien, Dodge said.

Also sentenced Friday:

• Sean Samaroo, 26, of Decatur, to 210 days in jail for embezzlement and lying to a peace officer.

• Joseph Robert Livingood, 51, of White Pigeon, to two years of prison for operating while intoxicated.

• Timothy Ryan Moss, 38, of South Bend, to 30 days in jail and 18 months of probation for operating while intoxicated.

• Gary Franklin Coons Jr., 22, to one year in jail for breaking and entering a building with intent and third-degree home invasion.
