NILES — A Niles man who pointed a gun at someone and threatened to shoot them in the head was sentenced Monday in Berrien County Trial Court.
Aaron Apolinar Macedo, 30, of Niles, pleaded guilty to attempted assault with a dangerous weapon and was sentenced to 60 days in jail with credit for two days served and $258 in fines and costs.
The incident occurred Sept. 3 in Niles.
Berrien County Assistant Prosecutor Kate Arnold called Macedo’s behavior “concerning”. She noted that Macedo had a weapon and pointed it at the victim and threatened to shoot the victim in the head. She also noted that Macedo had been unsuccessful on probation in the past.
Defense attorney Shayne Williams said Macedo is working full time and has a place to live. She said she thought Macedo could be successful on probation.
Macedo apologized for his actions.
“I take full responsibility for my actions, I want to move forward from this,,” he said.
“This situation could have been a lot worse,” Judge Smith said. “When you introduce a weapon into a situation, a lot of bad things can happen. Your past record includes a lot of domestic violence incidents. I don’t know what it will take for you to learn you can’t engage in this behavior.”
“You’ve had multiple violations on past probations,” she added. “I don’t think placing you on probation and hoping for the best is the best option. I hope you will be able to get your job back when you get out but I can’t ignore your past behavior.”
