NILES — A Niles woman was also sentenced to prison for home invasion Monday in Berrien County Trial Court.

Roxie Kay Hall, 32, of Niles, pleaded guilty to third degree home invasion and was sentenced to 14 months to five years in prison. She must pay $218 in fines, costs and restitution. She has no credit for time served because she was on parole from a prior home invasion conviction and prison term in Indiana at the time of the incident.

The incident occurred May 20 in Niles Township.

Vigansky said that he didn’t think the sentence should be probation when Hall has already been sentenced to prison for a similar crime. “I don’t think the court should go backwards,” he said.

Defense attorney Carri Briseno said that social workers in her office have been working with Hall to address the issues in her life. She noted that Hall was living in a hotel using meth and fentanyl before the incident and has lost her children to foster care.

Hall apologized for her actions and violating the trust of friends of hers by breaking into their home. She said she didn’t remember her actions on that day.

“The problem is that you go back to your old ways when you get out,” Judge Smith said. “When services were available, you didn’t use them. I don’t think probation is appropriate. If you don’t follow parole conditions, you won’t follow probation conditions. You need help and help has been placed in front of you and you didn’t use it.”

She noted that it’s very serious when a person invades someone home. “It is dangerous to them and to you,” she told Hall.
