Six sentenced for possession of meth in Cass County

CASSOPOLIS — Prison sentences were handed down to three men in sentencings Friday in Cass County Circuit Court.
A Mishawaka man convicted by a Cass County jury in September for resisting police and possessing methamphetamine learned his fate Friday.
Danzig James Weed, 26, of Mishawaka, was sentenced to three to 15 years with credit for 242 days already served for possession of methamphetamine as a habitual offender and to credit for 212 days served for resisting and obstructing police. He must pay $2,176 in fines and costs. He can serve his prison term in any penal institution.
The incident occurred March 17 on Pokagon Highway in Pokagon Township when police were called to reports of a vehicle on fire. Police found Weed, who initially refused to stop when police saw him walking away from the vehicle. A later search found the meth.
“His criminal history is replete with failures to appear and probation violations,” said Chief Assistant Prosecutor Tiffiny Vohwinkle. “He failed to appear twice in this case. I understand he has pending cases in Indiana but we can’t know what will happen there. I think three years in prison is appropriate.”
Defense attorney James Miller recommended sending Weed back to Indiana as soon as possible. For his part, Weed said his incarceration had a big impact on him as he missed the birth of his child.
Cass Circuit Judge Mark Herman was skeptical of Weed’s words.
“You’ve had six felony and eight misdemeanor convictions and seven probation violations,” he said. “You’ve spent time in prison in Indiana. I find it hard to believe this incarceration has had an impact after all the others. If it has had an impact, I hope you will use it to straighten your life.”
In other cases:
A Bay City man arrested last year in Milton Township after a traffic stop was sentenced to prison.
Brandin Scott Scheurs, 22, of Bay City, Michigan, pleaded guilty to possession of meth, receiving concealing or possession of a stolen vehicle and possession of marijuana and was sentenced to concurrent terms of three to 10 years and two to five years in prison on the first two counts and credit for 203 days served on the marijuana charge. He must pay $1,766.
The incident occurred April 22, 2018, at Center and Dibble Streets in Milton Township when police stopped him for reckless driving and found that there was a warrant for his arrest. He was given the chance last year to take part in the Adult Treatment Court but absconded from it for a year before he was arrested.
“He has had every opportunity to stop committing crimes,” Vohwinkle said. “He’s had every probation revoked.”
A Berrien Springs man was sentenced to prison after violating his probation from an October 2018 conviction for malicious destruction of a building near Niles by being kicked out of the Twin County Probation Program.
Herbert Lee McGraw II, 34, of Long Lake Road in Berrien Springs, pleaded guilty to violating his probation and was sentenced to two to 10 years in prison. He has credit for 402 days already served.
Vohwinkle noted that McGraw violated his probation by absconding as well as making threats.
“If somebody tells him no, he threatens them,” she said. “He doesn’t want treatment. He wants everything his way.”
McGraw said he wanted to stay in the program and pointed out that he never physically threatened anyone.
“I want the opportunity to continue my progress, it’s not my intent to show disrespect,” he said.
Judge Herman said he was disappointed that McGraw had wasted the opportunity given him. “At this point in time, there is no program available,” he said. “You are not welcome back at Twin County.”
Luis Antonio Martinez Jr., 34, of East Railroad Street in Dowagiac, pleaded guilty to possession of meth and was sentenced to eight months in jail with credit for 66 days already served. He must pay $1,548 in fines and costs. He can serve the jail term in any penal institution.
The incident occurred Sept. 4 when police searched a home on Gray Street in Dowagiac and found Martinez in possession of meth.
Corey Andrew Short, 34, of Three Rivers, pleaded guilty to possession of meth, possession of a dangerous weapon and driving with a suspended license and was placed on two years’ probation, ordered to serve 150 days in jail with credit for 71 days served on the first two counts and ordered to pay $1,998. He received credit for 71 days served on the driving charge.
The incident occurred July 11 in Marcellus.
Jaclyn Lee Mersereau, 42, of Orchard Street in Dowagiac, pleaded guilty to attempted larceny in a building and was sentenced to 18 months’ probation, credit for one day served, $115.97 in restitution and $1,728 in fines and costs. The incident occurred Dec. 21, 2017 when she broke into an Indian Lake Road home to steal money.
Ashley Lynn Rowe, 27, of Granger, pleaded guilty to possession of meth and was sentenced to 18 months’ probation, credit for 87 days served and $1,788 in fines and costs. The incident occurred Aug. 13 in Edwardsburg.
Amanda Michelle Waltz, 32, of Juniper Road in Niles, pleaded guilty to possession of meth and was sentenced to two years’ probation, credit for 122 days served and $1,788 in fines and costs. The incident occurred Nov. 9, 2018, at a home on Juniper Road in Howard Township near Niles.
