Three area residents sent to jail

NILES — Jail sentences were handed down Monday to three area residents in Berrien County Trial Court in Niles.
James Michael Conrad, 31, of Ontario Road in Niles, pleaded no contest to resisting and obstructing police causing injury and was sentenced Monday to two years’ probation, 90 days in jail, with credit for 59 days served, and $1,138 in fines and costs. He must complete the Tri-Cap program and then 90 days on tether.
He also received a concurrent 90-day jail term for operating while intoxicated.
The incident for both charges occurred May 4 in the 1300 block of Sheridan in Niles. According to the police report, Conrad had been beating on the door of his estranged wife’s home when police arrived. He grabbed onto Niles police officer Dan Nelson and had to be tased.
Nelson received injuries to his wrist and elbow. Conrad, who had a blood alcohol level of .149, nearly twice the legal limit, received injuries to his head when he beat his head against a partition in the police vehicle.
Berrien County Trial Judge Charles LaSata also ordered Conrad to comply with sex offender registration rules including not living in a residence with a child under 17 except his own children or reside within 1,000 feet of a school or 500 feet of a park.
Conrad served four years in prison earlier for a child molesting conviction.
“I really want to apologize to the court, my family and my friends,” Conrad said in court Monday. “Due to my drinking, I’ve lost a lot of their respect. I need to work on my problem and get some help.”
Another Niles man was sentenced to jail for a 2017 fleeing and eluding police incident.
Christopher Lee David, 51, of W. Main Street in Niles, pleaded guilty to fourth-degree fleeing and eluding police and was sentenced to 60 days in jail with credit for 10 days already served. He must pay $898 in fines and costs.
The incident occurred Feb. 9, 2017, and involved a police chase from Phillip and Niles-Buchanan roads in Niles Township south into Indiana, where he crashed at Cleveland and Mayflower Roads. He reached speeds of up to 110 miles per hour and at one point threw an object out of his car that hit a police car windshield.
According to the police report, David had sent threatening texts to Mishawaka police indicating that he was prepared for a high-speed chase and was armed with a handgun and sniper rifle.
Defense attorney Scott Sanford noted that David has already served a probation and jail sentence in Indiana for his action on the Indiana side of the state line during the 2017 incident.
“I made a big error in judgment that night,” David said. “It’s not something I normally would have done.”
Also Monday, a Buchanan man received a jail sentence after trying to pass a counterfeit $20 bill.
Dwayne Earl Moore, 42, of Hills Haven in Buchanan, pleaded guilty to attempted uttering and publishing of counterfeit bills and was sentenced to 60 days in jail with credit for nine days already served. He must pay $958 in fines and costs.
The incident occurred April 24 at the McDonald’s restaurant on E. Front Street in Buchanan where he tried to pass a counterfeit $20 bill.
LaSata agreed with Assistant Prosecutor Jerry Vigansky that placing Moore on probation would be setting him up for failure. Judge LaSata noted that Moore’s past record included a number of probation violations, contempt of court sentences and failure to appear bench warrants.
