Three men sentenced for various crimes

NILES — Three men were sentenced for various crimes Monday by Berrien County Judge Charles LaSata at the Berrien County Courthouse. One of the men, Clarence David Hurmon, will serve 23 months to 10 years in prison for armed robbery.
Hurmon, 29, of N. 6th Street in Niles, has a long criminal history across multiple states, said LaSata.
The crime for which Hurmon was sentenced began on Jan. 16 when he called a local restaurant and ordered fast food for pickup.
When the deliveryman arrived at the Four Flags Apartments address that Hurmon provided in the call, he found Hurmon outside the complex with a mask made of a black shirt and a gun.
Hurmon held a gun to the deliveryman’s face and robbed him of money, phone, keys and food.
After the deliveryman fled the scene, Hurmon made his way past the Niles District Library, whose surveillance cameras caught footage of him. Detectives were able to identify him. Harmon admitted to the crime while in Berrien County Jail, detained on unrelated charges.
Scott Clifford Moulton, 53, of County Road 687 in Silver Creek Township, was also sentenced. He pleaded guilty to three misdemeanors: possession of marijuana, unlawful use of a license and failure to arrive at a pre-trial conference.
He will serve 45 days in the county jail for all three misdemeanors. After serving, his driving privileges will be suspended for 100 days.
On March 29, Moulton ran his truck into a vehicle while its driver was waiting to turn left on S. 11th Street onto Main Street in Niles.
An officer was right behind the hit vehicle, waiting to turn left as well. When Moulton left his vehicle upon the officer’s orders, the officer smelled beer and, later, found a half-empty beer can in the truck.
Moulton said that someone had recently sold him the truck. He also advised the officer that he possessed marijuana paraphernalia.
The man was scheduled to attend a pre-trial conference for his arrest on May 15 but failed to attend. On Monday, Moulton told LaSata he was trying to follow instructions.
“I have done everything I was supposed to do — or at least tried to,” he said. “It’s all been confusing for me.”
“Well, I don’t think you’ve done well at all,” LaSata said.
Moulton will soon face a felony sentencing for driving under the influence of alcohol. His blood alcohol concentration was measured at .273 — more than three times the legal limit — at the scene of the accident. Moulton said he had been sober for two decades, and high stress lead him to drinking.
The final man sentenced Monday was Joshua George Gillette, 40, of Chicago Road in Niles. He will serve two years on felony probation for possession of methamphetamine and for driving with a suspended license and defective equipment. He must also pay $1,400 in fines.
Gillette was taken into custody after an officer stopped him in his vehicle for having a taillight out. The officer found that Gillette had a confirmed warrant for child support. When searching his truck, officers found a small black bag containing a clear glass pipe with residue on it and 0.9 grams of crystal methamphetamine.
“I made a mistake. It was my fault,” said Gillette, who followed by saying that he would try to stay sober.
LaSata said that Gillette had been in numerous programs for his drug use, and they each failed. When they fail, he said, jail and prison are next.
The judge said that felony probation was Gillette’s last chance before jail.
