Resident charged for maintaining a drug house

NILES — A man who was making meth from a Niles Township home was sentenced to prison for the crime Monday in Berrien County Trial Court.

Jason Charles Wyatt, 46, of the 100 block of Owen Street in Niles Township, pleaded guilty June 26 to the felony charge of possession of meth and maintaining a drug house.

Judge Charles LaSata ordered Wyatt to serve a minimum of two years to a maximum of 10 years in a Michigan state prison for the first charge. He was sentenced to 53 days in jail for the second charge. Wyatt has credit for 53 days served. His sentences will be served concurrently.

The charges stem from a search warrant which was executed by Berrien County Sheriff’s Department authorities who suspected that meth production was taking place in the 100 block of Owen Street  in Niles Township. The warrant was executed at approximately 2:35 p.m. Oct. 6, 2015, and no one was home at the time.

According to a police report, authorities located and seized drug paraphernalia, including an inactive one-pot meth cook, stripped lithium batteries, cold packs, coffee filters and hazardous waste materials that are commonly found from meth production.

Wyatt’s attorney Scott Sanford asked LaSata to consider a county jail sentence. He said his client “has not used” since 2016.

When it came his turn to speak, Wyatt declined to comment further.

Also sentenced Monday:

• Javier Daniel Huston, 20, of Dowagiac, was charged with fourth-degree police fleeing and operating while intoxicated. He pleaded guilty to the charges on June 20. He was sentenced to two years of felony probation, 90 days of SCRAM monitoring and 30 days in jail for the first charge. For the second charge, he was ordered to serve 19 days in jail. He has credit for 19 days served. His sentences will be served concurrently.

• Luvell McLeod was charged with assault with a dangerous weapon. He pleaded guilty to the charge on June 20. He was sentenced to 16 to 48 months in a Michigan state prison.
