Niles man gets probation after road rage incident

A Niles man whose blood alcohol level was three times higher than the legal limit received a probation sentence stemming from a road rage incident in May.
David-Mikel Allen Elam, 21, of Bryant Avenue, was sentenced Monday in Berrien County Trial Court to two years of probation and three months on an alcohol monitoring tether program. Judge Angela Pasula said Elam could face jail time if he does not comply with the terms of probation, which include him not consuming any alcohol.
“You were a real danger to yourself and everyone else out of the roadway,” Pasula said.
The sentence stems from when police were dispatched to the 800 block of Brown Street in Niles on May 24 on a report of a road rage incident.
A woman told police that Elam drove through a red light and almost hit the vehicle in which she was a passenger. The woman said she followed Elam, who continued to drive erratically, until Elam pulled into a driveway in the 800 block of Brown Street.
The woman confronted Elam, who pointed a starter pistol, or blank gun, at the woman, who thought the starter pistol was a real pistol, according to the police report. Elam said Monday he did not point the starter pistol at the woman, but that it was sitting on the passenger’s seat.
Police performed multiple blood alcohol level tests on Elam, resulting in readings of .20, .25 and .24, according to court documents. The legal limit in Michigan is .08.
Elam was also found to be in possession of brass knuckles, which are illegal in Michigan.
Elam pleaded guilty to attempted carrying of a concealed weapon (the brass knuckles) and operating a motor vehicle with a high blood alcohol content.
Elam apologized to the court and said he has learned from his mistake.
Pasula ordered Elam to pay more than $1,300 in fines and costs or spend 45 days in the Berrien County Jail on the drunken driving charge.
She placed him on probation for two years on the count of attempted carrying of a concealed weapon. He was also ordered to pay more than $1,400 in fines and costs on
that count.
Also Monday, Timothy Edward Milliken, 31, of Detroit Road in Niles, was sentenced to 120 days in jail and three years probation on one count of larceny in a building.
A homeowner caught Milliken stealing a lawn mower and other lawn-maintenance equipment from a garage in the 2600 block of S. 13th Street in Niles May 3, according to court documents. Milliken told the judge he has had a substance abuse issue with the drug, speed, for the past several months.
