A Niles man who stole a computer and several pounds of hamburger meat from the apartment of a man who was away at church will spend time in jail.

Jacob Alan Juday, 20, was sentenced Monday in Berrien County Trial Court to 60 days in jail on one count of attempted larceny in a building — a felony that carries a maximum penalty of two years behind bars.

The charge stems from an incident that occurred May 19 at a residence in the 1400 block of North Fifth Street in Niles.

According to court documents, police responded to that address on a larceny complaint. A woman at the residence said, while her son was at church, Juday and another man came over to the apartment and began snooping around.

When her son returned, he noticed that a laptop and computer cord were missing.

Police later located Juday at a home near Barron Lake in possession of the laptop, computer cord and five or six pounds of frozen hamburger.

Juday’s lawyer, Shannon Sible, said his client appears to be suffering from a mixture of substance abuse and mental health problems.

Juday apologized for his actions and said he needs to get out of a recent cycle of poor decisions.

“I do have a game plan to stay out of here (court),” he said prior to hearing his sentence.

Judge Dennis Wiley encouraged Juday to address his issues or else he might end up in prison or dead from a drug overdose.

Juday has credit for 51 days already served.

Also Monday, Victoria Heather Hardy, of Niles, was sentenced to one year of probation and 80 hours of community service on one count of possessing a taser without a license.

According to court documents, Hardy, 21, was involved in a fight and cycled the taser near a man she had a “bad vibe” about near Sixth and Ferry streets in Niles on June 4. Police pulled over a vehicle containing Hardy and she admitted to having a taser for her own protection. She said she didn’t know she needed a permit to carry the taser.
