Burglar sentenced

CASSOPOLIS – A 22-year old Edwardsburg man who broke into the Union Market on June 12, 2005, and stole beer and cigarettes will spend 150 days in jail.
Travis Kinder of M-205 received two years of probation and may be released after 120 days in jail if he pays off his fines and costs of $920 and $324.46 restitution for his conviction of breaking and entering a building with intent.
Circuit Judge Michael Dodge on Friday told Kinder that on Sept. 2 it was agreed to reduce his bond, but he was to stay out of trouble.
That didn't work out, and Kinder failed to appear for sentencing and remained at large.
Then, on Aug. 28, Elkhart, Ind., police were called to Kinder's house as a result of a neighbor's complaint and found out there was a warrant for his arrest.
Dodge noted his guideline range went up from zero to 9 to 11 months and now deserves jail time.
Kinder must also pay a $960 probation fee.
Also going to jail is Peter Acher, 30, of Leet Road, Niles, who got 60 days jail and 18 months probation for manufacturing more than 20 marijuana plants on April 19.
Chief Assistant Prosecutor Jason Ronning asked for a sentence according to his guideline range.
Defense attorney James Tracey said Acher is a hard worker in asking for a suspended jail sentence.
He said Acher supports his children, wife, sister and mother.
Dodge recalled Michigan State Police went to Acher's residence on a tip and found marijuana in his house and 93 plants growing outside his home.
Dodge noted Acher has used marijuana since 1998 and is an assistant foreman since 1999 at Prescision Plastics. He said his marijuana habit if continued will cause more serious problems.
Dodge suspended Acher's jail time for six months to see how he complies on probation. He is to pay $570 costs and a $720 probation fee.
Others sentenced are as follows:
David Slone, 29, Maple Island Road, Dowagiac, 270 concurrent days jail for resisting and obstructing a police officer and a probation violation on July 15 on Allen Street, Dowagiac for narcotics possession. He was also given credit for time served of 55 days for attempted resisting and obstructing a police officer. He is to pay $120 costs.
David Buzzard, 47, 19854 Stateline Road, Edwardsburg, two years probation plus 90 days jail for possession of a firearm by a convicted felon suspended for six months, and credit for time served of two days for possession of marijuana on April 12 in Edwardsburg. He is to pay $600 probation fee, $1,065 costs and $61 restitution.
Torrian Lopez, 26, 10522 E., M-60 Jones, two years probation plus 120 days jail for manufacturing marijuana on April 22 at Kirk Lake, Vandalia. He is to pay $960 probation costs an $1,170 costs.
Courtney Ifill, 67, Michigan Department of Correction, five years to 90 months for assault with intent to do great bodily harm less than murder on Sept. 13, 2003, (ok) on Telegraph Street, Dowagiac. His term is concurrent with his current term. He is to pay $860 costs and $32,070 restitution.
Victor Vasquez, 39, 1733 Oak Street, Niles, one year jail for third-degree fleeing police and credit for time served of 93 days for operating a vehicle while intoxicated June 29 on M-51 Dowagiac. He is to pay $1,020 costs.[ok]
Aaron Hartman, 22, 413 Keene Avenue, Dowagiac, two year probation plus 90 days jail for resisting and obstructing and concurrent 90 days for attempted resisting obstructing on June 30 on M-51 Dowagiac. He is to pay $960 probation, $615 costs and $173.20 restitution.[ok]
